Terms and Conditions

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into the promotion open on 29/06/22 and close at 5:00PM AEST on 29/07/22 (“Promotional Period“).
  5. To enter the promotion, entrants must, during the Promotional Period:
        1. Visit;
        2. Follow the prompts to the entry page;
        3. Select their favourite “Energy Play” from the list provided;
        4. In 20 words or less, provide an answer to the question “Why is this Energy Play your favourite?”;
        5. Fill in the required details including their name, email address, phone number and postcode; and then
        6. Submit the full completed entry form.Once the above steps have been completed, entrants will receive one (1) entry into the draw.
  6. Multiple entries are permitted, subject to the following: (a) only one (1) entry permitted per submission in accordance with the steps above; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of five (5) entries permitted per person..
  7. Entrants warrant and agree that:
        1. they will not submit, produce, upload or share any content that is fraudulent, or may be in breach of any intellectual property, privacy or other rights;
        2. they will not submit, produce, upload or share any content that the Promoter may deem to be defamatory, obscene, derogatory, offensive, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
        3. no rights in the entry have been previously granted to any person, corporation or entity;
        4. they will obtain full prior consent from any person who has jointly created or has any rights in the entry or who appears (or who’s property appears) in the content forming part of the entry;
        5. they will comply with all applicable laws and regulations including without limitation those governing copyright, content, defamation, privacy, publicity and the access of use of others’ computer or communication systems; and
        6. the Promoter may remove any content or disqualify any entrant without notice for any reason whatsoever.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant
  10. Incomplete or indecipherable entries will be deemed invalid.
  11. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 04/08/22 at 10:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by telephone and by email and their names will be published on-line at from 05/08/22.
  12. The first valid entry drawn will win a trip to Adelaide, SA for two (2) people, valued at up to $3,421 depending on point of departure (“Major Prize”). Major Prize includes:
    • Two (2) x general admission tickets to the Rugby Championships match between Australia and South Africa, which will take place on 27/08/22 at Adelaide Oval, SA.
    • Two (2) x return domestic economy class tickets to and from winner’s nearest capital city to Adelaide, SA (if required);
    • Two (2) x tickets to a long lunch event (“Lunch”), which will take place on 26/08/22 at the Adelaide Oval; and
    • Two (2) nights of accommodation in the Stamford Plaza Hotel, Adelaide. For clarity, this will be two (2) separate rooms.
  13. The next two (2) valid entries drawn will each win a signed Wallabies jersey, valued at $160 RRP each.
  14. The next three (3) valid entries drawn will each win a signed Wallabies football, valued at $60 RRP each.
  15. Major Prize does not include spending money, additional meals, taxes, insurance, travel documentation, vaccinations, transport to and from the Rugby Champions match, transfers, items of a personal nature and all other ancillary costs. Major Prize must be taken to coincide with the Lunch on 26/08/22 and the Rugby Championships game on 27/08/22 and is subject to booking and flight availability.
  16. The Major Prize winner may be required to present their credit card at time of accommodation check in. Major Prize is subject to the terms and conditions of individual service providers. Frequent flyer points will not form part of the Major Prize unless specified otherwise.
  17. Major Prize winner and companion must travel together. In the event that the Major Prize winner is under the age of 18 years of age, a nominated parent/guardian must accompany the Major Prize winner.
  18. Subject to the unclaimed prize draw clause, if for any reason a winner does not or cannot take a prize (or part of a prize) at the time stipulated by the Promoter, then that prize (or part of the prize) will be forfeited. For the avoidance of doubt, if a winner does not arrive for the scheduled flight on time or cannot fly for any reason, then the winner will forfeit that part of the Major Prize.
  19. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  20. In the event a winner or winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
  21. A draw for a prize, if unclaimed, may take place on 22/08/22 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner(s), if any, will be notified by telephone and by email. Winner’s names, if any, will be published on-line at from 23/08/22.
  22. Prize is not transferable or exchangeable and cannot be taken as cash.
  23. The total prize pool is valued at up to $3,921.
  24. This promotion is a game of chance. Skill plays no part in determining the winner. The Promoter’s decision is final and binding and no correspondence will be entered into.
  25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  27. Any cost associated with accessing the Promoter’s website is the entrant’s responsibility and is dependent on the Internet service provider used.
  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  30. Entrants’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter’s database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at The Promoter’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.
